Updates made to Quarry Springs Alcohol Use Agreement

An update to the Colfax Park and Recreation Auxiliary Board Alcohol Use Agreement, specifically for the use of Quarry Springs Park facilities was approved during the June Colfax City Council meeting. The agreement is to be used in conjunction with the Facility Use Agreement for Quarry Springs and all terms of that agreement apply to the Alcohol Use Agreement.

“It is our desire that all patrons who periodically use our Block Building/Community Shelter are able to enjoy the facility,” the board said. “The Alcohol Use Agreement has been set in place to achieve that goal and includes all rules and regulations surrounding the use of alcohol in the facility and at the park.”

Terms of the agreement including only beer and wine or other similar drinks, wine coolers, seltzer (with alcohol content 17 percent or less by weight) can be consumed, those drinks can only be consumed in the building, not on park grounds, glass containers are not allowed, only those of legal drinking age can have the beverages, drinks can only be consumed by those in attendance at the private event and all rules, laws, regulations and terms of use are enforceable and at the discretion of the local police department or any law enforcement.

Fees for alcohol at an event are $50 for a small event (less than 75 people), $75 for a large event (75 or greater in attendance) or $100 for weddings. There is also an additional $100 deposit fee for serving alcohol that is returned if the facility is found to be in acceptable conditions following the event. The alcohol fees are in addition to the rental fees.

Also, a part of the agreement is indemnification and insurance. It states the rental shall indemnify, decent and hold harmless the Colfax Park and Recreation Auxiliary Board, its officers, employees and agents from any and all losses, costs, expenses, claims, liabilities, actions or dances, including liability for injuries to any person or persons or damage to property arising at any time during and/or arising out of or in any way connected with renter’s use of the facility and adjoining property. This is the case unless it is solely caused by the gross negligence or willful misconduct of the board, its officers, employees or agents.

The renter is also to have general liability insurance against any and all losses, costs, expenses, claims, liabilities, actions or damages including liability for injuries to any person or persons or damages to property arising at any time during and/or arising out of or in any way connected with renter’s use of the facility. It is also said the renter will report any personal injuries or property damage and the renter waives any right of recover again the board, officers, employees and agents for indemnification, contributions or declaratory relief arising out of or in any way connected with the renter’s use of the facility and adjoining property, even if the board, officers, employees or agents seek to recover against the renter.

The council also approved the final reading for water rate increases. For 2021-22, the first 2,000 gallons used per month will be rated at $31.19 per month, the minimum bill. Anything more than 2,000 gallons used per month will be charged at $6.26 per 1,000 gallons. The rate increases take effect July 1.
