Newton Police Department

• Jerry E. Bird Jr., 31, of Newton was arrested Monday and charged with operating a motor vehicle while intoxicated, third offense, after authorities responded to a theft complaint at Hy-Vee at 12:35 a.m. and then stopped the suspect’s vehicle at 400 E. 41⁄2 St. S. in Newton. Bird failed sobriety tests and was charged for allegedly driving while intoxicated and cited with careless driving. He was transported to the Jasper County Jail. No charges were issued in connection with the reported theft.

• Perry J. Graham, 50, of Newton was arrested Friday and charged with simple domestic assault, interference with official acts, disorderly conduct and assault on a peace officer after authorities responded to a complaint of a domestic dispute at 3:41 p.m. at 315 First St. S. #308. Graham was charged for allegedly assaulting a female, hitting a police officer in the arm and yelling and swearing loudly in the hallway during his arrest. He was transported to the Jasper County Jail.

• Levi J. Harms, 16, of Newton was charged Saturday with possession of alcohol while under the legal age after authorities stopped a vehicle in which he was a passenger at 12:11 a.m. in the 100 block of East 14th Street North. An officer located beer in the vehicle, and Harms admitted he had been drinking. The driver of the vehicle, 18-year-old Aaron J. Wilson of Newton, was cited for having an open container of alcohol in his vehicle, and both were referred to Juvenile Court Services.

A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
