employee won’t be charged

DES MOINES (AP) — Polk County Attorney John Sarcone says he’s declining to bring charges against an Iowa Department of Public Safety employee who misused a police database.

Sarcone said Thursday that three prosecutors in his office reviewed the matter and there was a consensus not to bring criminal charges.

The employee in question has not been identified. DPS says it learned Sept. 9 of a complaint of involving the potential misuse of the Iowa Criminal Justice System by a department employee, and launched a criminal investigation.

Sarcone says the information that was improperly accessed would have been available through Iowa’s online courts database. He says prosecutors could not show criminal intent.

DPS says a disciplinary investigation has been launched.
